Utah Uniform Electronic Estate Planning Documents Act Signed into Law

LIVE Coalition Applauds Expansion of Digital Estate Planning Access

WASHINGTON, D.C. (March 26, 2026) — Utah Governor Spencer Cox signed House Bill 181, the Uniform Electronic Estate Planning Documents Act, into law, marking a significant step forward in modernizing estate planning access and security. The new law authorizes the electronic execution and notarization of non-testamentary estate planning documents and builds on Utah’s earlier adoption of electronic wills.

With this legislation, Utah becomes the seventh state to enable end-to-end digital estate planning.

The Legacy, Innovation & Virtual Estate Planning (LIVE) Coalition applauds Governor Cox and state leaders for advancing policies that improve access, affordability, and efficiency for families.

“Utah continues to lead the way in embracing thoughtful, technology-driven solutions that make estate planning more accessible,” said Kristina Howard, Executive Director of the LIVE Coalition. “By enabling fully digital execution of essential documents, this law removes unnecessary barriers and empowers families to plan for the future with greater ease, security, and peace of mind.”

Under HB 181, families can now create and execute key estate planning documents, including trusts, powers of attorney, and advance healthcare directives, through secure digital processes. The law will reduce administrative burdens, lower costs, and make it easier for individuals to plan for pivotal life moments. By streamlining these processes, it also expands access to estate planning tools, reduces avoidable court involvement and taxpayer costs, and generates meaningful savings for Utah families

“This legislation gives advisors, institutions, and attorneys modern tools to serve their clients better, reducing administrative friction, increasing efficiency, and allowing more time to focus on substantive legal guidance rather than process”, said Jon Warenne, CEO of Estate Guru, a Utah-based estate planning company and member of the LIVE Coalition.

With HB 181, Utah continues to set the standard for forward-thinking estate-planning policy and paves the way for broader nationwide adoption of digital solutions.
